I heard that if a family applies together, it is more difficult to be found eligible because the family is more likely to travel to the U.S. together and stay there illegally. Also, it is more difficult to be found eligible if an applicant has relatives living in the U.S.?
Both rumors are not true. Traveling as a family or having relatives living in the U.S. does not hurt an application. In fact it is better for a family to apply together. Each applicant must qualify for a nonimmigrant visa (NIV) on his/her own merits. Section 214(b) of the Immigration and Nationality Act, as amended (INA) requires us to consider all applicants as intending immigrants until they establish that they have a residence abroad, which they do not intend to abandon. Successful NIV applicants are able to show sufficiently strong family, social, economic and professional ties to Korea that would compel them to return after a temporary stay in the United States. Having relatives in the U.S. does not hurt or help an applicant. Making an accurate, complete application helps.

Is it easier to get a visa if the applicant¡¯s parents have U.S. visas or if the applicant gets a letter of invitation from U.S. citizen?
Each applicant must qualify for a visa on his/her own merits according to his/her purpose of travel to the U.S. The mere reason that an applicant¡¯s parents hold U.S. visas does not automatically make the applicant eligible. It is helpful, however, because if the child¡¯s parents have been found eligible, the child is likely to be found eligible based on the parents¡¯ ties to Korea.
U.S. law puts no weight on letters of guarantee for an NIV application. We do not require nor request letters of invitation, letters of sponsorship or the like. If a third party has information on a NIV applicant, he/she should send it directly to the applicant who can share it with us during the interview. Due to our large volume of mail, it is impossible for us to store a letter and retrieve it at the time of application.

No, many students who are on a leave of absence or attending a junior college are found eligible for visas. The primary considerations, as in other cases, are an applicant's ties to Korea. If an applicant can show sufficient social and/or economic ties to Korea at the time of application, they will probably be found eligible for a visa.

Is it possible to get a U.S. visa if I have been working for the company less than one year? Also, what if one of my family members in the U.S. is in illegal status?
We treat each case on its own merits. There is no formula other than we must see compelling reasons for an applicant to depart the U.S. after a visit. It is possible for an applicant to receive a visa even if he has been working for an employer for less than a year. However, in order to issue a visa, consular officers must determine that an applicant has sufficient social and/or economic ties to a country outside the United States. A long period of employment is considered one strong economic tie.
When an applicant's family member is residing in the U.S. unlawfully, we understand that they obtained visitor visas under false pretenses or that they have not abided by the terms of that visa, making it difficult for us to believe an applicant¡¯s claimed reasons to depart the U.S. However we do treat each case on its own merits.

I heard that it is difficult for religious or old aged people to get a student (F1) visa. Is this true?
In order to qualify for a student (F1) visa, applicants must be able to show that they have sufficient ties - such as academic, social, family and financial - to finish the planned course of study and return to Korea. Mere acceptance at a school in the U.S. only allows the applicant to seek a F1 visa; it does not imply issuance.
There is nothing in immigration law giving any disadvantage to an elderly or religious based applicant. The same requirements apply to all F1 applicants. It is necessary for all F1 applicants to show they will be bona fide students and that their proposed course of study makes sense considering their past experiences and future plans here in Korea. The F1 visa is not a means to prepare someone for a life in the U.S., it is allow applicants to get sufficient education to advance their life in their home country.

U.S. law requires that all visitor and student visa applicants show sufficiently strong family, social, professional or economic ties to a residence abroad to ensure that their stay in the U.S. will be temporary. Generally, yes. The requirements for a F1 visa are different than the requirements for a B1/B2 visa. Therefore, it is possible to be found eligible for a B1/B2 visa, but ineligible for an F1 visa. In some cases, the consular officer may cancel the previously issued B1/B2 visa. If ineligible for a F1 visa the holder of a still valid B1/B2 must not study in the U.S.; doing so can result in permanent visa ineligibility.

We have a Fraud Prevention Unit (FPU) that specifically deals with such cases. Applicants are free to obtain information and forms from any source they desire to contact. We prefer that applicants rely on our website for accurate and official downloadable forms and information. We blacklist anyone who attempts to seek a visa by fraud. We would very much like to cut the wait time down for applicants. Unfortunately, if we reduce the numbers of appointments we would serve fewer applicants. Unfortunately about 20% of our appointments are no-shows, which takes away from legitimate applicants. There are a lot of people who do not know the reason why they were found ineligible. The Consul General stated that interviewer explains the reason of ineligibility but most of applicants do not agree. Applicants wish to hear the specific reason they were found ineligible in order to prepare their reapplication. I would like the Consul General to tell the interviewing officers about this.
U.S. law presumes that all applicants intend to immigrate, and it is the applicant's responsibility to establish that he or she does not intend to immigrate. Officers determine through the interview whether the applicant has sufficient social and/or economic ties to overcome the presumption that he or she intends to immigrate. The most common reason for visa ineligibility that the applicant failed to show sufficient ties to overcome that presumption. In addition, each applicant found ineligible is given a letter explaining his or her ineligibility and reapplication procedures.

Why is the visa processing fee $100 and how is it used?
The Department of State (DOS), which is responsible for visa adjudication at U.S. Embassies and Consulates outside of the U.S., must pay for its visa operations with user fees collected under the Border Security Program. The machine-readable visa (MRV) fee was introduced in 1994 and must be adjusted periodically to reflect the actual cost of visa processing. How is the validity of a visa determined?
The validity of a visa is based on a world-wide reciprocity schedule. Depending on the alien¡¯s nationality or circumstances, visas can be issued for any number of entries, from as little as one entry to as many as multiple (unlimited) entries, for the same purpose of travel. Is it true that if a person changes status from visitor (B1/B2) to student (F1) or worker (H or L) while in the U.S., he/she cannot obtain a visa if he/she departs the U.S. (Is there any penalty for changing status in the U.S.)?
There is no penalty for legally changing status from one visa classification to another classification while in the U.S. If a person received a change of status (COS) from B1/B2 to F1 and then departs the U.S., that person must qualify for a F1 visa before returning to the U.S. to resume his/her studies. In addition to the required F1 visa application materials, the applicant should provide proof of legal COS and legal status in the U.S. The applicant must, like every other applicant, qualify on his/her own merits and demonstrate strong social and/or economic ties to Korea.
When a person changes status in the U.S., the consular officer at the followon visa interview will look at two things: 1. Did the person originally intend to gain entry into the U.S. with a B1/B2 visa for another purpose, such as to study or work? 2. Did the applicant remain within the law and apply for a change of status in a timely manner? The applicant must demonstrate that his/her initial entry as a visitor, for example, was made in good faith, and then did everything required to remain in legal status. A change in status does not guarantee visa eligibility and the applicant must qualify in the same manner as all other applicants.

The validity on a visa does not equal duration of stay on that visa. The validity of a State Department-issued visa states the period of time during which an applicant can seek entry into the U.S., while while entry into and duration of stay in the U.S. is determined by a Department of Homeland Security (DHS) inspection officer at the port of entry (POE). The expiration date for the visa should not be confused with the authorized length of your stay in the U.S., which given to you by the U.S. immigration inspector at the POE, on the Arrival-Departure Record, Form I-94, or I-94W for the Visa Waiver Program. The visa expiration date on your visa has nothing to do with the authorized length of your stay in the U.S. for any given visit.
When a student enters the United States on an F1 or M1 visa, he/she will usually be admitted for the duration of student status, which is as long as he/she is a full time student, even if the F1 or M1 visa in the student¡¯s passport expires while he/she is in the U.S. For example, if you have a student visa that is valid for five years that will expire on May 1, 2004, and you are admitted into the U.S. for the duration of your studies (often abbreviated in your passport or on your I-94 as "D/S"), you may stay in the U.S. as long as you are a full time student. Even if January 1, 2004 passes and your visa expires while in America, you will still be in legal student status, if you are a full time student. However, if you depart the U.S. with an expired visa, you will need to obtain a new visa before returning to the U.S. and resuming your studies. An F1 or M1 visa cannot be renewed or re-issued in the United States; it must be done by a State Department consular officer at a U.S. Embassy or Consulate abroad.

The Consul General mentioned that one of the reasons why it is not easy for Korea to get a visa waiver is because of the passport security issues. If the Korean passport changes, would it increase the likelihood of getting a visa waiver or simplifying the current visa process? Also, weren¡¯t there any discussions with the Korean government regarding the passport?
Entry into the visa waiver program (VWP) is determined by U.S. law as enacted by Congress in Washington DC. We have no role in determining what countries are included in the VWP.
There are several issues surrounding Korea¡¯s eligibility to enter the VWP.
Visa Eligibility: The visa refusal rate of the country must be below 3% and stay below that percentage for at least 3 consecutive years. Although Korea¡¯s refusal rate is low, it has never dropped below the required percentage.
Passport: All VWP countries must issue machine-readable passports that are tamper resistant. Korean passports are partially machine-readable, but are not reliable and do not contain such security features as biometric identifiers or a digitized photo.
Security: Over 60,000 Korean passports were reported as lost or stolen in 2003, a very high rate for a country of under 50 million persons. In the post September 11 environment, national security interests make it less likely that countries will be added to the VWP. Currently, several countries have been taken out of the program or are on probation. The ROK government is well aware at the highest levels of the U.S. concerns regarding the security of Korean passports and the high loss rate of passports.
An important point to make about the VWP as it is currently structured is that the waiver is not a single "solution." The VWP only covers short-term business or tourism to the U.S. Even in VWP countries, people seeking to study, work, invest, perform, etc. in the U.S. must apply and qualify for the appropriate visas. The criteria for those types of visas are exactly the same in waiver countries as they are now in Korea.

If I have a valid visa in an expired passport, can I still use it or should I apply for a new visa?
If you have a valid visitor (B1/B2) visa, use that visa for business or pleasure until it expires, even if the passport it is in has expired. An unexpired visa is still valid in an expired passport. DO NOT REMOVE the visa or the page on which it appears in your expired passport. Simply present both your old and new passports to immigration authorities in the U.S. If you lose your passport, which has a valid visa, and find it later, do not use. You must apply for a new visa in your replacement passport.
